Terms and Conditions

These Terms of Service are a translation of the German original and are provided for information purposes only. In the event of any discrepancy between the two versions, the German shall prevail.

1. General

Thank you for visiting the bulb-flow.ch website and for your interest in our products. Please take note of the following legal information. Unless otherwise stated, all trademarks on this site are the property of Innique AG and protected by trademark law.

All intellectual property on the website, including proprietary information, text, images, videos, animations, products and other design rights, copyrights and trademark rights, is legally protected. The website does not grant any licence to use this intellectual property. Enquiries about permission to use content should be directed to Innique AG.

2. Liability

We have taken the greatest of care when creating this website. Nonetheless, we cannot give any guarantee that the information it contains is accurate and free of errors. We do not accept any liability for loss or damage arising directly or indirectly from the use of the website, except where it was caused intentionally or as a result of gross negligence.

3. Copyrights

All text, images, graphics, animations and videos displayed on the bulb-flow.ch website and the layout of these elements are copyright of Innique AG. No reproduction, distribution or other use is permitted.

4. Contractual parties and subject matter

These Terms of Service are agreed between Innique AG and the customer.

Innique AG offers the customer the products available for sale/the ordered goods subject to these Terms of Service. These Terms of Service apply to the online retail relationship between Innique AG and the customer. The Terms of Service may be amended at any time. They apply exclusively. Conditions that contradict or differ from these Terms of Service are not recognised except where this has been expressly agreed in writing in a given case.

5. Conclusion of contract

Orders are binding on the customer. The contract between the customer and Innique AG is concluded when the customer places their order on the online store. Innique AG accepts the order by confirming it. By placing an order, the customer confirms that they are of legal age or have the permission of their parent or guardian, and expressly accepts these Terms of Service as the basis for the contract.

6. Payment conditions

We will deliver the ordered goods upon receipt of payment.

7. Delivery conditions and costs

We carefully and securely package all orders, and dispatch them via DPD. Unless otherwise agreed, the goods will be delivered to the delivery address specified by the customer. The customer is responsible for ensuring that it is possible to deliver the goods to this address. The customer must notify Innique AG beforehand of any factors that will impede delivery. No deliveries shall take place on Sundays or public holidays. If the delivery address is not or not easily accessible by normal delivery vehicles (especially addresses in mountainous or car-free areas), delivery will be made to the nearest generally accessible location that can be reached without additional expense or effort (e.g. a valley station). The method of delivery will depend on the ordered goods and is chosen by Innique AG.

Innique AG reserves the right to limit the quantity of orders. If an item ordered by the customer is not in stock, this will not affect the delivery of the other items. Any unavailable items will be delivered separately at a later date.

A delivery charge of CHF 7 applies for parcel post. Shipping charges are shown separately.

8. Exports/customs duties

Deliveries outside of Switzerland may incur import duties, which are payable by the customer. Any import/customs duties and fees are included in the delivery costs.

9. Cancellation of order

If, despite a contractual obligation, parts for an ordered good are no longer available from one of our suppliers and this makes it difficult for us to fulfil the order through no fault of our own, and where this difficulty is not merely temporary in nature, we are entitled to cancel the order. In the event of cancellation, we will inform you immediately of the non-availability of the items and promptly refund any payment already received.

10. Complaints

Goods that have been delivered incorrectly or in the incorrect quantity or that are defective or faulty will be replaced as soon as possible, provided that you inform us promptly after receipt of the defective goods and return them unused and in their original state (including the original packaging). Before returning the items, you must contact Innique AG by email hello@innique.ch or telephone +41 (0)43 8337 733. If you notice any obvious defects when you take receipt of the goods, you must notify Innique AG within seven days in writing or by sending photographic evidence. Please include the order number. If any obvious, externally visible damage has occurred during shipping, you should obtain written confirmation of this damage from the delivery company upon acceptance of the goods.

11. Returns/right of cancellation

If the customer wishes to return products for which they have no right to compensation as per section 12, they can make a request within seven days of receipt. It is at the sole discretion of Innique AG whether to accept this request, since we are not obliged to do so. Only unused items in their original packaging will be accepted. For returns via a Swiss Post branch, a processing fee of CHF 5 and a delivery charge of CHF 7 will be deducted from the amount refunded. You must not return goods without contacting Innique AG beforehand by email hello@innique.ch or telephone +41 (0)43 8337 733.

12. Liability disclaimer and warranty

Innique AG vouches that the products are undamaged at the time of shipping and is only liable for direct damage resulting from our own deliberate or grossly negligent action. This liability is limited to the purchase price. Innique AG shall not assume liability for direct damage resulting from slight negligence, regardless of legal ground, except where statutory obligations apply. We will not accept liability for indirect or consequential damage. In particular, Innique AG accepts no liability for damage caused by wear and tear, user errors, improper use, external factors, non-observance of safety procedures, external intervention or product-specific wear, or for damage to items other than the delivered goods.

13. Privacy

Our contact form asks you to submit personal data. We treat all data entrusted to us with the greatest of care, strictest confidentiality and in accordance with the statutory provisions set out in the Swiss Federal Act on Data Protection (FADP) of 19 June 1992. Innique AG will not share your data with third parties without your express consent.

14. Place of jurisdiction and applicable law

All disputes relating to these Terms of Service are subject to Swiss law. The customer accepts Grüningen, Switzerland, as the sole place of jurisdiction (the same applies with regard to magistrate’s and debt enforcement offices).

15. Amendments to these provisions and conditions

Innique AG can amend these provisions and conditions at any time by updating this legal notice. Any such amendments are binding on you, so you should visit this page regularly to view the current version.

16. Severability clause

If individual provisions of these Terms of Service are void or ineffective in whole or part, this does not affect the validity and effectiveness of the other provisions or parts thereof. The void or ineffective provisions shall be replaced by legally effective ones that come as close as possible to the intended economic purpose. The same shall apply in the event of any missing provisions.

Data protection

We are pleased that you are interested in our website. Protecting your privacy is very important to us. We treat your personal data confidentially and in accordance with the statutory data protection regulations and this data protection declaration. We would like to point out that data transmission on the Internet (e.g. when communicating by e-mail) can have security gaps. A complete protection of the data against access by third parties is not possible. Below we inform you in detail about the handling of your data.

Access data and hosting

You can visit our website without providing any personal information. Each time a website is called up, the web server automatically saves a so-called server log file, which contains, for example, the name of the requested file, your IP address, date and time of the call, the amount of data transferred and the requesting provider (access data) and documents the call. This access data is evaluated exclusively for the purpose of ensuring trouble-free operation of the website and improving our offer. In accordance with Article 6 Paragraph 1 Clause 1 Letter f GDPR, this serves to protect our legitimate interests in a correct presentation of our offer, which predominate within the framework of a weighing of interests. All access data will be deleted no later than seven days after the end of your visit to the site. As part of processing on our behalf, a third-party provider provides us with hosting and display services for the website. This serves to protect our overriding legitimate interests in a correct presentation of our offer within the framework of a balancing of interests. All data that is collected as part of the use of this website or in the forms provided for this purpose in the online shop as described below is processed on its servers. Processing on other servers only takes place within the framework explained here. This service provider is based in Switzerland or in a country of the European Union / European Economic Area.

Revocation

Many data processing operations are only possible with your express consent. You can revoke consent that you have already given for reasons that arise from your particular situation. An informal message by e-mail to us is sufficient. The legality of the data processing that took place up until the revocation remains unaffected by the revocation. After you have exercised your right to object, we will no longer process your personal data for these purposes. This does not apply if the processing is for direct marketing purposes.

Contact option

If you have any questions about the collection, processing or use of your personal data, information, correction, blocking or deletion of data and revocation of consent given or objection to a specific use of data, please contact us directly using the contact details in our imprint.
